Non-Fault Accident? What Actually Happens to Your Claim (And Why It Matters Who Manages It)

If you’ve just been in an accident that wasn’t your fault, the paperwork can feel more stressful than the crash itself. Within minutes of exchanging details, you may find yourself being contacted by your own insurer, the other driver’s insurer, and sometimes a third-party accident management company — all before you’ve had a chance to work out what actually happens next.

Here’s what’s really going on behind the scenes, and why the company you choose to manage your claim has a direct impact on your car, your courtesy vehicle, and your wallet.

Your Legal Right, in Plain English

Under English law, if you weren’t at fault for an accident, you’re entitled to be put back in the position you were in before the crash. That means the at-fault driver’s insurer is responsible for the cost of your repairs and for keeping you mobile while your car is off the road.

Crucially — and this is the part most drivers aren’t told — you are not obliged to use the repairer your insurer suggests. You have the legal right to choose who repairs your car, regardless of which insurance company is footing the bill.

The Three Routes a Non-Fault Claim Can Take

Once you report a non-fault accident, your claim will typically go down one of three paths. Understanding the difference matters, because each one changes who’s actually looking after your interests.

1. Your insurer’s own approved network Most insurers maintain a panel of “approved” repairers. These arrangements exist primarily to keep the insurer’s costs down, not to get you the best repair. Repairers in these networks are often selected on price, which can mean pattern (non-genuine) parts and a workshop under pressure to turn cars around quickly rather than to the manufacturer’s standard.

2. A third-party accident management company Sometimes a claim gets picked up by an accident management company, who arrange your replacement vehicle and liaise with insurers on your behalf, then place the repair with whichever bodyshop suits their own commercial arrangements. This can still work well for the driver — but it adds another layer between you and the workshop actually doing the work, and you may not get a say in who that is unless you ask.

3. Direct with the repairer of your choice This is the route most drivers don’t realise is available to them. You can go straight to a bodyshop you trust — one with the right manufacturer approvals and accreditations for your specific car — and they manage the whole claim on your behalf: liaising with the at-fault insurer, arranging your replacement vehicle, and handling the repair in-house from start to finish. Nothing gets handed off to a third party you haven’t chosen.

Why the “Who” Matters More Than People Think

The company managing your claim decides things that directly affect the outcome:

  • Which parts go on your car. Genuine, manufacturer-approved parts versus cheaper aftermarket alternatives.
  • What replacement vehicle you get. A “like-for-like” hire car — matching your own, whether that’s a family SUV, an EV, or a prestige model — versus a generic small hatchback.
  • How long it takes. A repairer working to their own schedule versus one working to a management company’s turnaround targets.
  • Whether your no-claims bonus is protected. Handled correctly, a non-fault claim through the at-fault party’s insurer should leave your NCB untouched.

None of this is complicated once it’s explained — but it’s rarely explained at the roadside, which is exactly when most drivers make the call that sets their claim in motion.

What to Do If You’ve Just Had a Non-Fault Accident

Before you agree to anything over the phone, it’s worth pausing to ask:

  • Who am I speaking to — my insurer, the other driver’s insurer, or a management company?
  • Am I free to choose my own repairer, and has that been made clear to me?
  • What parts and standards will be used for my repair?
  • What replacement vehicle am I entitled to, and for how long?

You’re allowed to take a breath and make this decision on your own terms — it doesn’t have to happen in the first phone call after the accident.

At the Scene: What to Gather (If It’s Safe to Do So)

Whatever route your claim ends up taking, the details you collect in the first few minutes make everything afterwards faster and more straightforward. If you’re able to, try to note down:

  • Third-party details — full names, addresses, phone numbers, and emails of all drivers and passengers involved.
  • Vehicle details — make, model, and registration numbers for every vehicle involved, plus a quick description of the damage.
  • Photographic evidence — clear photos from multiple angles (front, rear, sides, and corners) of all vehicles.
  • Scene context — the date, time, and precise location, along with road and weather conditions if relevant.
  • Witness details — contact information for anyone who saw what happened.

It’s worth keeping a simple checklist like this in your glovebox or on your phone, so you’re not trying to remember what’s needed while you’re still shaken up.

  4. Precision Repair — your vehicle is restored using genuine manufacturer parts and the latest diagnostic equipment, and you can follow progress through our online portal.
  5. The Handover — once your car has passed our quality control checks and had a full valet, we deliver it back to your door and collect the replacement vehicle.
